Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Orion Chime website at orionchime.com and any related services (collectively, the "Service"), operated by INVENTORYCHECKER("we", "us", "our"). By using the Service, you agree to be bound by these Terms.

During the domain migration, older inventory checker domains may redirect to the relevant Orion Chime page. These Terms apply when you use the Service.

1. The Service

Orion Chime is an independent third-party availability monitoring service. The first active module monitors publicly available iPhone availability information published by Apple Inc. and notifies users when selected products become available at selected locations. We are not affiliated with, endorsed by, or sponsored by Apple Inc. All product names, logos, and brands are property of their respective owners.

The Service is currently offered free of charge. Each user can create a limited number of active alerts and receive a limited number of notifications within a rolling time window; once you sign in, current limits are shown in your account.

Important — we do not guarantee a successful purchase. Inventory is shared with the entire public; a product that is in stock when we send you an alert may be sold out seconds later to someone else. Our Service notifies you of availability — it does not reserve, hold, or buy anything on your behalf. See Section 4 for details.

2. Eligibility & Accounts

You must be at least 13 years old (or the minimum age in your jurisdiction) to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and current information when registering and to keep it up to date.

3. Acceptable Use

You agree not to:

  • Use the Service to violate any applicable law or regulation.
  • Resell, sublicense, or commercially redistribute the Service or data obtained from it.
  • Reverse engineer, scrape, or attempt to circumvent rate limits, authentication, or access controls.
  • Use automated systems (bots, scripts) to interact with the Service in a way that places undue load on it.
  • Use the Service to engage in scalping, fraud, or any activity that violates Apple Inc.'s terms of sale or applicable consumer protection laws.
  • Upload or transmit any malicious code, or attempt to gain unauthorized access to any part of the Service.

We may suspend or terminate accounts that violate these rules, with or without notice.

4. No Guarantee of Purchase, Availability, or Accuracy

You acknowledge and agree that:

  • We do not guarantee that you will be able to buy the product. Inventory is publicly available and is purchased on a first-come, first-served basis by anyone in the world. A product that is in stock at the moment we send an alert can sell out within seconds. We have no control over Apple's checkout system, allocation, queueing, or purchase limits.
  • Alerts may be late, missed, or inaccurate. Inventory data is sourced from publicly available endpoints and is provided as-is. Apple may change, delay, throttle, or withhold inventory information at any time, and intermediate networks or providers may delay delivery of notifications.
  • We do not buy products on your behalf. The Service notifies; it does not reserve, hold, queue, or check out on your account.

We are not responsible for sold-out products, failed purchases, missed allocations, pricing changes, or any other action or decision by Apple Inc. or any retailer.

5. Intellectual Property

The Service, including its design, code, content, and trademarks (excluding third-party trademarks such as "Apple" and "iPhone"), is owned by us and protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for your personal or internal business purposes.

6. Third-Party Services

The Service relies on third-party providers including Google services (Firebase authentication, Google Analytics, reCAPTCHA) and email/notification providers. Your use of those features is subject to those providers' terms and privacy policies. See our Privacy Policy for details.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR PURCHASING OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS WILL NOT EXCEED USD $50.

9. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Service.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (including IP, disclaimers, and limitation of liability) will survive.

11. Changes to These Terms

We may update these Terms from time to time. We may notify you by posting updates, in-product notice, or email where required. Continued use after the effective date constitutes acceptance.

12. Governing Law & Disputes

These Terms are governed by the laws of the country in which we are established. To the extent permitted by law, any dispute arising under these Terms will be resolved in the competent courts of that jurisdiction. Nothing in these Terms limits any non-waivable consumer protection rights you have under the law of your country of residence.
