Terms of Service

These Terms of Service ("Terms") govern your access to Orion Chime at orionchime.com and related services (the "Service"), operated by INVENTORYCHECKER ("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms and our Privacy Policy. Older inventory-checker domains may redirect to Orion Chime; these Terms still apply.
1. The Service
Orion Chime is an independent availability-monitoring service. It monitors publicly available product availability information and can send email or SMS alerts for products and locations you select. We are not affiliated with, endorsed by, or sponsored by Apple Inc. Third-party product names, logos, and brands belong to their owners.
Apple and iPhone are trademarks of Apple Inc., registered in the U.S. and other countries and regions. Apple Store is a service mark of Apple Inc. Orion Chime is independent and has not been authorized, sponsored, endorsed, or otherwise approved by Apple Inc.
We do not reserve, hold, queue for, or purchase products. Inventory is shared with the public and can change within seconds. An alert does not guarantee that information is current or that you will complete a purchase.
2. Eligibility and Accounts
You must be at least 13, or the minimum age required in your jurisdiction, to use the Service. You must provide accurate account information, keep it current, protect your credentials, and promptly tell us about suspected unauthorized use. One person or coordinated group may not create or operate multiple or related accounts to obtain additional free-tier usage or evade limits, trials, eligibility gates, access controls, or abuse protections.
3. Plans and Service Limits
The Service may offer free and paid plans. Current prices, included features, alert limits, and notification limits are shown on the Plans page and again in Stripe Checkout before payment. Features and limits may differ by plan, country, product, delivery channel, or beta cohort. SMS availability may be limited to supported countries and phone numbers.
4. Paid Subscriptions
This Section is the paid-service agreement recorded as Billing Terms version billing-2026-08-15. When you buy a paid plan, Stripe Checkout requires you to accept these Terms before completing payment.
Recurring billing authorization
Paid plans are recurring subscriptions. By subscribing, you authorize Stripe and us to charge the payment method you provide for the price and billing interval shown at Checkout, and on each renewal date until the subscription is canceled. Checkout displays the final amount, currency, applicable discounts, and any additional charges before you confirm.
Payment processing
Stripe processes payments and stores payment-method details under its own terms and privacy policy. We receive billing identifiers, payment and subscription status, plan and price identifiers, and your recorded Terms acceptance; we do not receive your full card number.
Renewal, plan changes, and failed payments
Your subscription renews automatically at the interval displayed in Checkout. Plan changes, effective dates, and any prorated amount are shown in the Stripe-hosted billing flow before you confirm. If a payment fails or remains unpaid, we may retry it and may limit or suspend paid features while preserving any rights required by law.
Cancellation and refunds
You may cancel through Manage Billing in your Orion Chime account. Unless the Stripe Portal shows a different effective date, cancellation takes effect at the end of the current paid period and access continues until then. See our Cancellation Policy. Charges are handled under our Refund Policy and any non-waivable rights that apply where you live.
No purchase-result promise
Subscription fees pay for monitoring and notification features, not a product reservation or successful purchase. A missed, delayed, inaccurate, or unsuccessful alert does not by itself entitle you to a refund.
5. Acceptable Use
You must not:
- break applicable law or use the Service for fraud, scalping, or unlawful activity;
- resell, sublicense, or commercially redistribute the Service, access to it, alerts, or its data without permission;
- scrape, reverse engineer, overload, or disrupt the Service;
- circumvent authentication, rate limits, account limits, eligibility gates, or security controls;
- submit malicious code or attempt unauthorized access; or
- use bots, scripts, browser automation, or other automated means to access or search the Service unless we expressly permit it.
If we reasonably believe that you have violated these rules—including through reselling, scalping, scripting, scraping, automation, related-account abuse, or free-tier quota evasion—we may, with or without advance notice, investigate, rate-limit or block searches, pause or stop notifications, restrict related accounts or technical identifiers, suspend access, or terminate the account. These measures may apply to free and paid accounts, and we may act immediately when reasonably necessary to protect the Service, its users, third-party providers, or legal rights.
6. Availability and Accuracy
Inventory sources, retailers, networks, email carriers, mobile carriers, and other providers can change, delay, throttle, or withhold information. Alerts can be late, missed, duplicated, or inaccurate. We do not control retailer checkout, allocation, queues, prices, purchase limits, or whether a retailer accepts an order. You remain responsible for checking product, price, seller, and purchase terms before buying.
7. Intellectual Property
The Service, including its design, code, content, and Orion Chime branding, is owned by us or our licensors and protected by intellectual-property laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for personal or internal business purposes.
8. Third-Party Services
The Service relies on providers including Google/Firebase, Google Cloud, Stripe, Twilio/SendGrid, analytics, security, retailer, and network services. Their products are governed by their own terms and privacy policies. Our Privacy Policy explains relevant data sharing.
9. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE ACCURATE, UNINTERRUPTED, SECURE, OR ERROR-FREE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, REVENUE, DATA, PRODUCTS, OR PURCHASING OPPORTUNITIES. OUR TOTAL LIABILITY ARISING FROM THE SERVICE WILL NOT EXCEED THE GREATER OF USD $50 OR THE AMOUNT YOU PAID US DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. NOTHING HERE EXCLUDES LIABILITY OR CONSUMER RIGHTS THAT CANNOT LAWFULLY BE EXCLUDED.
11. Suspension and Termination
You may stop using the Service at any time. Canceling a paid subscription and closing an Orion Chime account are separate actions. We may suspend or terminate access for a Terms violation, security risk, nonpayment, legal requirement, or discontinuation of the Service. Provisions that should survive by their nature—including payment obligations, IP, disclaimers, liability limits, and disputes—will survive.
A restriction, suspension, or termination may apply even if you have a paid plan. If we permanently terminate all paid access, we will prevent future subscription renewals. Fees already paid for the current period are not automatically refundable except under our Refund Policy or where applicable law requires otherwise. When appropriate, we may provide notice after taking action, but we may withhold details where disclosure would undermine security, abuse prevention, an investigation, or a legal requirement.
12. Changes to the Service or Terms
We may change the Service and these Terms. For material changes, we will provide notice where required, such as in the Service or by email, and state the effective date. Changes to paid terms apply prospectively as required by law. If you do not agree, stop using the Service and cancel before the next renewal.
13. Governing Law and Disputes
These Terms are governed by the laws applicable where we are established, without limiting any non-waivable consumer rights you have where you live. Disputes will be heard by courts with competent jurisdiction unless applicable law requires another process.
